1. About Kaya5

Kaya5 is a wellness education platform that provides Ayurvedic knowledge, community discussion, and practitioner-reviewed content. The Platform is operated by Kaya5 Inc. (“Kaya5”, “we”, “us”). Contact us at admin@kaya5.com.

2. Accounts

• You sign in to Kaya5 using your Google account. By doing so you authorise us to receive your name, email address, and profile photo from Google.
• You are responsible for all activity that occurs under your account.
• You must not share your account credentials or allow others to use your account.
• You must be at least 16 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these terms.

3. User-generated content

When you submit questions, answers, or other content to the Platform:

• You retain ownership of your content.
• You grant Kaya5 a worldwide, royalty-free, non-exclusive licence to display, store, reproduce, and distribute your content on the Platform and in associated promotional materials.
• You confirm that your content does not infringe any third-party intellectual property rights and does not violate any applicable law.
• All user-submitted content is reviewed by our moderation team before being made publicly visible. We reserve the right to reject or remove any content at our discretion.

4. Kaya Guru content

Kaya Gurus are Ayurvedic practitioners who have been verified and invited to contribute to the Platform. Their answers are reviewed before publication. However, Kaya Guru responses are educational in nature and do not constitute a practitioner-patient relationship or personalised medical advice. The presence of a “Kaya Guru Answer” badge indicates the answer was authored by a verified practitioner, not that it has been approved as medical guidance for your specific situation.

5. Prohibited conduct

You must not use the Platform to:

• Post false, misleading, or harmful health information.
• Impersonate any person or entity or misrepresent your credentials.
• Spam, solicit, or advertise products or services without our written consent.
• Harass, abuse, or threaten other users or Kaya Gurus.
• Scrape, crawl, or extract data from the Platform by automated means without our permission.
• Attempt to circumvent content moderation or security measures.
• Upload or transmit viruses, malware, or any other malicious code.
• Violate any applicable local, national, or international law or regulation.

6. Intellectual property

All Platform content that is not user-generated — including the Kaya5 name, logo, design, original articles, the Dosha Quiz, and software — is owned by Kaya5 Inc. and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without our written permission.

7. Disclaimers

The Platform is provided “as is” without warranties of any kind. We do not warrant that:

• The Platform will be available without interruption or error.
• Any content on the Platform is accurate, complete, or up to date.
• Results from the Dosha Quiz accurately reflect your Ayurvedic constitution for clinical purposes.

To the fullest extent permitted by law, Kaya5 disclaims all implied warranties, including warranties of merchantability and fitness for a particular purpose.

8. Limitation of liability

To the fullest extent permitted by applicable law, Kaya5 and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms or your use of the Platform will not exceed the greater of USD $100 or the amount you paid to us in the twelve months preceding the claim.

9. Third-party links

The Platform may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites. Linking to a third-party site does not imply endorsement by Kaya5.

10. Changes to the Platform and these terms

We reserve the right to modify or discontinue any part of the Platform at any time. We may also update these Terms of Service. Continued use of the Platform after changes are posted constitutes your acceptance of the updated terms. We will notify registered users of material changes by email.

11. Termination

You may stop using the Platform at any time. We may suspend or terminate your access at any time if you violate these terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform immediately ceases. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property provisions) will do so.

12. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of Colorado.
